TORT REFORM UPDATE: Senate Bill Moving Slowly
Senate bill S.244 – the Justice Act of 2025 – faced unexpected opposition following an amendment proposed by Sen. Stephen Goldfinch (R – Murrells Inlet), leading many to believe it would not advance. However, a group of senators collaborated to develop a series of compromises. Two primary alternatives emerged, one sponsored by Sen. Michael Johnson (R-York) and another by Sen. Shane Massey (R-Edgefield), the original bill’s primary sponsor.
On Tuesday, Sen. Johnson’s amendment was introduced, extensively debated into the evening, and ultimately passed. This amendment addressed all aspects of the original bill except for "joint & several" liability, which was designated for consideration under Sen. Massey’s amendment. Originally scheduled for discussion on Wednesday, this amendment has been postponed until next week.
For further details on these amendments, please visit our Tort Reform Resources page on our website. We strongly encourage continued engagement with your representatives—momentum is critical, and the fight for meaningful reform is ongoing. Trial lawyers are circulating misleading information, making it essential for you and your clients to remain actively involved in advocating for a fair and balanced civil justice system. (+ More...)
