Tort Reform  in South Carolina

Resources to share with clients

As you know, tort reform in South Carolina has been much needed for years. The current legal climate presents significant challenges for insurers, businesses, and consumers alike due to the loopholes in the current law that can hold a business unfairly accountable. The Justice Act of 2025 (S.244) has been filed and we are cautiously optimistic on the progress it has already made. We feel confident that, if passed, this legislation will strengthen our business environment, increase market availability, and reduce insurance premiums.

IIABSC has updated our Tort Reform resource page with several documents from the Coalition for Lawsuit Reform to  help you understand specifically what the Justice Act of 2025 is seeking to do.

Your involvement is crucial in shaping a more sustainable business climate and insurance market in South Carolina.  We encourage you to reach out to your local legislators and urge them support the Justice Act of 2025.
